A legal disclaimer
These Terms & Conditions ("Terms") govern all vehicle transportation services provided by Prestigithe Customer. By booking transport services, Customer agrees to be bound by these Terms.
1. SERVICES PROVIDED
Prestigious Auto Transport to arrange for or provide transportation of Customer's vehicle from the pickup location to the delivery location identified in the Transport Agreement . All services are subject to availability, carrier scheduling, weather, road conditions, and operational factors.
2. BROKER VS CARRIER DISCLOSURE
Carrier Services If Prestigious Auto Transport is acting as a motor carrier, Prestigious Auto Transport will transport the vehicle using its own equipment and drivers .
Broker Services If Prestigious Auto Transport is acting as a transportation broker, Prestigious Auto Transport will arrange transport with a licensed third-party motor carrier . Prestigious Auto Transport does not physically transport vehicles when acting solely as a broker. Responsibility for cargo loss or damage rests with the assigned carrier once the vehicle is picked up.
3. PRICING & PAYMENT TERMS

Total pricing is outlined in the Transport Agreement.

Deposit is required to secure scheduling and is non refundable.

Remaining balance is due upon delivery unless otherwise agreed.

Accepted payment methods may include e-transfer, cash or credit card.

Vehicles will not be released until full payment is received
Prestigious Auto Transport reserves the right to charge administrative or processing fees where applicable. Additional fees may be applicable and are stated under "additional Fees".
4 a. LIMITATION OF LIABILITY
Company's liability is limited to the lesser of:

Cost of repair
-
Actual cash value of vehicle
-
Carrier's insurance policy limit
Under no circumstances shall Company be liable for:

Loss of use
-
Rental expenses
-
Travel costs
-
Loss of income
-
Indirect or consequential damages.
Carrier shall not be liable for mechanical malfunctions, including but not limited to oil leaks, coolant leaks, transmission leaks, or other mechanical failures not caused by external physical damage during transport. Liability shall not exceed the total transport fee paid.
4 b. LIMITATION OF LIABILITY

Mechanical Condition Clause: Prestigious Auto Transport shall not be responsible for mechanical malfunctions or failures including but not limited to engine damage, transmission issues, oil leaks, coolant leaks, battery failure, or other mechanical defects .

Pre-Existing Damage Clause: Prestigious Auto Transport is not responsible for any pre-existing damage, including but not limited to prior body damage, mechanical issues, or fluid leaks that were not noted or visible at the time of pickup inspection .

Undercarriage Clause: The undercarriage of the vehicle is not inspected at pickup or delivery due to practical limitations . Carrier shall not be liable for damage to the undercarriage.

Fluid Leak Clause: Prestigious Auto Transport shall not be responsible for fluid leaks including oil, transmission fluid, brake fluid, coolant, or power steering fluid .

Consequential Damages Clause: Prestigious Auto Transport shall not be liable for indirect, incidental, or consequential damages including loss of use, loss of time, rental vehicle expenses, lodging, or other related costs .

Customer Responsibility Clause: Customer certifies that the vehicle is in safe operating condition and free of fluid leaks prior to transport .

Inspection Acknowledgment: Customer acknowledges that the vehicle was inspected at pickup and agrees that any new damage must be noted on the Bill of Lading at the time of delivery .
5. ESTIMATED PICKUP & DELIVERY WINDOWS
Customer acknowledges that pickup and delivery dates are estimates only, not guaranteed delivery dates . Delays may occur due to:

Weather conditions
-
Traffic or road closures
-
Mechanical issues
-
Government inspections
-
Carrier scheduling
-
Border delays (if applicable)
Prestigious Auto Transport will make reasonable efforts to meet estimated timeframes but shall not be liable for delays beyond its control.
6. CANCELLATION POLICY

Cancellation within 24 hours from booking: Deposit refundable minus $100 admin fee.

Cancellation after 24 hours after booking or after carrier assigned or dispatched: Deposit is non-refundable.

Cancellation after vehicle pickup: Customer responsible for full transport fee and any storage or redelivery costs.
All cancellations must be made in writing (email accepted).
7. INSURANCE COVERAGE
If operating as a Carrier: Prestigious Auto Transport maintains cargo liability insurance up to $250,000.00 per vehicle .
If operating as a Broker: Company arranges transport with a licensed and insured motor carrier. Carrier's cargo insurance will apply. Coverage includes:

Damage caused during transport while vehicle is in carrier's possession.
Coverage does NOT include:

Pre-existing damage
-
Mechanical failure
-
Fluid leaks
-
Personal items left in vehicle
-
Acts of God (see Force Majeure)
Customer's personal auto insurance remains primary for comprehensive claims unless otherwise stated by law.
8. VEHICLE CONDITION & DAMAGE CLAIM PROCESS

Vehicle will be inspected at pickup and delivery.

A Bill of Lading (BOL) will be signed at both pickup and delivery.

Any new damage must be noted on the delivery BOL at time of delivery. Failure to note damage at delivery may result in denial of claim.
Claims Process:

Written claim must be submitted within 5 calendar days of delivery.

Include photos, repair estimates, and signed BOL.
-
Claims will be processed through carrier's insurance provider.
Company is not responsible for:
-
Minor scratches consistent with normal road wear
-
Damage caused by loose or aftermarket parts
-
Mechanical or electrical malfunctions
9. BROKER VS CARRIER DISCLOSURE
Carrier Disclosure: Prestigious Auto Transport is a licensed motor carrier and will transport the vehicle directly .
Broker disclosure: Company is a transportation broker and does not transport vehicles directly . Company arranges transport with a licensed third-party carrier. Customer acknowledges that carrier will assume responsibility once vehicle is picked up. Carrier information will be provided prior to pickup.
10. LIMITATION OF LIABILITY
Prestigious Auto Transport liability is limited to the lesser of:

Cost of repair, or

Actual cash value of vehicle, or
-
Carrier's insurance policy limits
Prestigious Auto Transport shall not be liable for:

Loss of use
-
Rental car costs
-
Travel expenses
-
Loss of income
-
Consequential or indirect damages
Under no circumstances shall Prestigious Auto Transport's liability exceed the total transport fee paid.
11. FORCE MAJEURE
Prestigious Auto Transport shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to: severe weather, natural disasters, government action, war, labour disputes, border closures, pandemics, or road closures . In such events, delivery timelines may be adjusted accordingly without penalty.
12. CUSTOMER RESPONSIBILITIES
Customer agrees to:

Remove all personal belongings from vehicle
-
Disable alarms
-
Ensure vehicle has no more than 1/4 tank of fuel
-
Provide working keys
-
Ensure vehicle is in safe operating condition (if declared running)
Company may refuse transport if vehicle is unsafe.
13. GOVERNING LAW
This Agreement shall be governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
14. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or representations .
15. REFUSAL OF SERVICE
Company reserves the right to refuse service without liability if:

The vehicle is unsafe to transport

There are excessive fluid leaks
-
Vehicle contains personal belongings not disclosed
-
Vehicle size or condition differs materially from what was disclosed
-
Customer or location presents safety concerns
If refusal is due to misrepresentation by Customer, deposit may be non-refundable.
16. CHARGE BACK & DISPUTE CLAUSE
Customer agrees not to initiate a credit card chargeback, payment reversal, or banking dispute without first providing written notice to Company and allowing Company a reasonable opportunity to resolve the issue . Customer must notify Company in writing within 5 calendar days of delivery of any billing dispute. Initiating a chargeback without prior written dispute resolution efforts shall constitute a material breach. If a chargeback is filed improperly, Customer agrees to reimburse Company for the full disputed amount plus fees .
17. ENTIRE AGREEMENT
These Terms, together with the signed Transport Agreement and Bill of Lading, constitute the entire agreement between the parties . No verbal statements or promises outside of these documents are binding.
ADDITIONAL FEES
1. STORAGE FEES
If the Customer fails to accept delivery or make the vehicle available for pickup at the agreed time and location, storage fees of $100 CAD per day, effective the day after the due delivery date . Customer is responsible for all storage, redelivery, and additional transportation costs incurred due to delay caused by the Customer. Vehicle may be placed in secure third-party storage at Customer's expense, especially if delivery is out of the province of British.
2. INOPERABLE VEHICLE FEES
Vehicles that are non-running or require special equipment for loading or unloading will incur an additional fee of $250 CAD, unless otherwise agreed in writing . If the vehicle is misrepresented as operable and is found to be inoperable at pickup, Customer agrees to pay the additional fee or transport may be refused without refund of deposit. Inoperable is not limited but may include no keys, no working brakes, cannot steer or seized wheel.
